WI stream access?
Is it legal to park on the shoulder/ road ditch to launch a kayak in a ditch that runs under the road? This is in Wisconsin. Private land on both sides of ditch.

Re: WI stream access?
My answer is yes.
Other people may also say yes, since you are parking the vehicle in the road right of way.
Others may say no, since you are parking the vehicle on private property.
The only person that really matters is the LEO that would issue you the ticket. In WI, that is not the DNR. Trespass is usually handled by the county sheriff.
Or, call the landowner and ask for permission.

If you’re parked on the shoulder of the road and you’re not obstructing traffic you can park there. If you can float a canoe or a kayak in water, even if it goes through private property it’s legal.

Re: WI stream access?
No clue about Wisconsin. In Pennsylvania not all waterways are considered navigable, including the majority of large streams. The courts have to rule that the stream/river was historically navigable and used as a public highway.

Re: WI stream access?
In WI yes. ANY water is navigable and legal up to the high water mark.
I wade a 2 ft wide by ankle deep stream to get to some isolated and mostly surrounded by private public land. One landowner called on me and the deputy that showed told me amd him i’m good to go as long as i don’t get out of the little creek.

Re: WI stream access?
There is one stream that I would love to do this on by me, but the private landowners post the heck out of both sides the road, making it appear like you cant. I dont feel like fighting with them so I have not pursued it.

I believe as long as you don't cross the road right of way while entering or exiting the stream you should be a non-trespasser.

Re: WI stream access?
As stated, you can access. I have done this a number of times to get to some public with my Jon boat. I checked with the local sherif, and he said as long as your car is off the road, and traffic can see your car, no problem.
